Policy Bills Supported and Enacted
HB 1160 - No Disclosure of Death or Illness A seller or renter of
property cannot be compelled to disclose that a previous occupant
of the property either had or died or a serious illness (provided
that a seller cannot knowingly make a false statement).
SB 282/ - Communicable Disease Law Change Anti-discrimination,
informed consent. See 7-27-89 Update.
Policy Bills Supported and Defeated
S 74 - LRS ATDS Study Would have extended the legislative study
commission on AIDS for another two years. Defeated in House.
Policy Bills Opposed. Modified and Enacted
HB 1149 - AIDS/Henatitis Test Required AIDS Control Measures now
allow health directors to order testing of persons who may have
exposed another (there must be a reason to believe the person is
infected and the exposure must pose a risk of transmission).
This bill allows a judge to detain someone for up to 24 hours to
allow health directors to determine if testing should occur. The
person detained must have been arrested and charged with a crime,
and exposed a police officer. This is a significant change from
the original bill which would have authorized a judge to hold an
accused for 72 hours and order testing directly instead of having
to call in'the health director. (See 5-16-89 Update.)
HB 304 - Prisoner's AIDS Test Original provisions defeated (test
all prisoners) and changed to a six-month blinded prevalence
study of new inmates and report to the General Assembly by
Department of Corrections on policy recommendations.
