LAST WILL M) TESTAMENT
OF
BERTHA L. CONE
I, Bertha L. Cone, a citizen and resident of the Town of Blowing
Rock, in Watauga Comity, North Carolina, being of sound mind and memory,
but considering and realizing the uncertainty of my earthly existence
and desiring to provide for the final disposition of all my worldly goods
and estate, do hereby revoke and declare utterly void, ineffective and invalid all wills, codicils and testamentary instruments heretofore made and
executed by me and do make, declare, publish and constitute this as and for
my last will and testament, in manner and form as follows, to-wit:
I direct that my body shall be cremated and buried beside that of
my husband, Moses H. Cone.
I direct that my Executor shall pay out of the general principal
funds of my estate;
(a) as soon as practicable after my death, all my
funeral expenses and just debts; and
(b) at the proper time or times, all administration
expenses, including court costs and attorneys'
fees, and all inheritance, estate or succession
taxes, dues or levies, Federal or State, which
may be properly or lawfully charged, assessed
and levied against my estate or against any of
the beneficiaries hereunder, or against any interest of any of the beneficiaries hereunder.
I hereby nominate and appoint Security National Bank of Greensboro,
a corporation organized and existing under the laws of the United States,
with its principal office in Greensboro, North Carolina, as Executor of this
my last will and testament.
I give and bequeath to Security National Bank of Greensboro, as
Trustee, to be by it held, managed and disposed of in the manner and for
the uses and purposes and subject to the terms and conditions hereinafter
set out, the sum of ($160,000.00) One Hundred Sixty Thousand Dollars:
(a) The Trustee shall pay out of the income of the trust estate,
or out of the principal of the trust estate if necessary, all taxes, fees
and expenses incurred by the Trustee in the administration and preservation
of the trust estate, including, commissions, trustee's fees and attorneys'
fees, if any. The Trustee shall also pay out of the income of the trust
