DRAFT POSITION PAPER £0^H.^ . ^ The Need and Basis for the Appointment of a Special Prosecutor In the November 3rd Case Introduction New information which has come out in the past six weeks has given more indications of possible government involvement in the Greensboro killings and attempts to cover-up. This information has made the question of whether justice is possible through the grand jury proceding in Winston-Salem a pressing one. Public interest demands a serious investigation and public disclosure of all allegations of government wrong-doing. An investigation conducted by the Justice Department, an agency which is itself implicated in the allegations, is not sufficient. In light of the information available implicating the government, and the handling of the case to date by the Justice Department, an independent special prosecutor from outside the Justice Department is called for. Information Concerning Government Involvement To summarize some of the recent revelations: 1) On June 9, 1982 Joe Grady, a Winston-Salem Klan leader, said he testified that he met with Greensboro FBI agents shortly prior to November 3rd to warn them of possible trouble in Greensboro on Nov. 3rd. FBI officials have denied they had any prior warning of trouble. 2) On June 23, 1982 Roger Shannon, A Nazi who was active in the same Winston- Salem Nazi unit as BATF agent Bernard Butkovich but. who wasn't present Nov. 3rd, said he testified that Butkovich called him on the afternoon of Nov. 3rd after the killings and asked him to hide fugitives and Butkovich's AR 15 weapon. He also described Butkovich as having attempted to instigate other illegal acts and as being "the most violent talking person in the group". 3) On July 8, 1982, Ms. Daisy Crawford, a former Cannon Mills textile worker from the Salisbury area who knew Sandi Smith, stated to the press that FBI agents approached her during the week before November 3rd and showed her pictures of Sandi Smith and several men she thought were also involved with WVO/CWP. Ms Crawford has been interviewed by the Justice Dept. but has not been scheduled to testify. FBI officials have denied there was any investigation of WVO/CWP prior to Nov. 3, 1982. 4) On July 15, 1982, Edward Dawson, the klansman and longtime FBI informant who was a police informant among the klan on Nov. 3rd, testified that (among other points): (a) police officials made a point of telling him CWP had changed the starting point of the march, and that he should get a copy of their parade permit; (b) police paid him to go to the klan rally in Lincolnton where he recruited the very klan who came to Greensboro and shot and killed people; (c) he told the police in various conversations before and on Nov. 3rd that a large number of klan were coming and that they were armed; (d) the DA's office accepted his refusal to testify in the 1980 trial by not subpoenaing him or enforcing the subpoena. Police have claimed they did not know where the demonstrators were starting from Nov. 3rd. This information is in addition to information previously available , including the following: 1) BATF agent Bernard Butkovich was present at thes formation of the Klan/Nazi United Racist Front and the Winston-Salem meeting of Klan and Nazis at ■■":'■ - ■ .
